Family of victim in fatal Texas Tesla crash files lawsuit over automated driving assistance system.

A woman was killed in a crash involving a Tesla on Friday night in Katy, Texas, prompting a lawsuit against the car manufacturer and the driver.

The incident occurred at approximately 8 p.m. when a Tesla Model 3 struck a residential home, according to the Harris County Sheriff’s Office. The victim, identified as 76-year-old Martha Avila, was inside her house and was subsequently airlifted to a hospital, where she was pronounced dead.

Authorities reported that the driver, Michael Butler, was operating the vehicle with an automated driving assistance system engaged at the time of the crash. He showed no signs of intoxication and was cooperative with police.

The suit, filed by Avila’s daughter, alleges negligence and claims there was a “design defect” in the Tesla vehicle and a failure to provide adequate warnings. The family is seeking over $1 million in damages.

The crash is currently under investigation, and no charges have been filed. The National Highway Traffic Safety Administration has announced a special investigation into the incident.

Witnesses reported that the Tesla entered the home at a high rate of speed, pinning Avila in the wreckage. A doorbell camera reportedly captured the crash. First responders were acknowledged for their quick response and professionalism by the Avila family.
