Lawsuit Filed Following Fatal Crash Involving Impaired Driver in Maine

ADDISON, ME — The girlfriend of a man killed by an impaired driver in April 2024 has filed a federal civil rights lawsuit against three police officers.

David Worcester, of Lamoine, died in a collision after Nicholas Libby, who had been stopped for erratic driving, was allowed to leave a traffic stop. The incident occurred on Route 1 in Steuben approximately one hour after Libby was initially pulled over by ELLSWORTH POLICE and the HANCOCK COUNTY SHERIFF’S OFFICE.

The lawsuit, filed on April 10 by Lisa McGlothlin, claims the officers violated her civil rights by allowing Libby to re-enter the roadway despite clear signs of intoxication. It also names the City of Ellsworth and Hancock County as defendants.

According to the complaint, Libby was found in possession of cannabis and Clonazepam during the stop and had only 63 tablets left, indicating overuse. Libby was on probation, barring him from using drugs, and law enforcement reportedly contacted his probation officer during the stop.

Witnesses reported further erratic driving from Libby before he crossed the centerline, resulting in the fatal collision that also killed Worcester’s dog. Following the crash, Libby tested positive for multiple substances, including cannabis and benzodiazepines.

Libby later pleaded guilty to manslaughter and received a 15-year prison sentence, with five years to serve and four years of probation. Officials at the City of Ellsworth have declined to comment on the ongoing lawsuit.
